A vape licence in Ireland is required for retail sales of nicotine inhaling products. The HSE licensing system began on 2 February 2026, and the transition for existing retailers ended on 2 August 2026. Tobacco sales require a separate licence.

Do you need a licence to sell vapes in Ireland?
Yes, if you retail products covered by the nicotine inhaling product rules. Licensing is already operating; it is not a future proposal. The Department of Health announced the start date and six-month transition in its licensing announcement.
There is a specific exception for qualifying existing retailers who applied during the prescribed transition and are still awaiting a decision. That exception comes from section 25 of the Public Health (Tobacco Products and Nicotine Inhaling Products) Act 2023. Do not assume that submitting a late application permits continued trading.
Who needs a vape licence?
The HSE requires separate licences for each retail premises and each website. For example, two shops and one website need three nicotine inhaling product licences if all three sell those products. A retailer selling tobacco as well needs the corresponding tobacco licences too.
The statutory definition determines whether a product is covered. A nicotine-free label does not, by itself, settle the licensing position of a device designed for nicotine use. Ask the HSE about borderline products. A retail licence also does not establish that a cannabinoid product is lawful under other legislation.
How to apply
Applications go through the HSE National Environmental Health Service online portal. Create an account, complete the licensing application for the business and relevant premises or website, and pay the applicable fee. The HSE licensing page links to the portal and lists the information required.
Prepare the business owner's details, Revenue identifiers and trading details before starting. Applicants must be at least 18 and meet the eligibility conditions, including tax clearance. Temporary or movable premises, such as festival stalls, are excluded from the retail licensing scheme.
The HSE reviews the application and may request corrections. Once approved, the licence can be downloaded. Shops must display it at the point of sale; online retailers must display their licence number on the website.

These are the current licensing fees, confirmed by the Department of Health and HSE. Each licence lasts 12 months, so a retailer with several outlets must budget for each one.
Renewal requires the licence details, a declaration of compliance and any changed information, alongside current tax clearance and the fee. Under section 15, a licence remains valid pending the renewal decision where the application was submitted at least 30 days before expiry. Keep a dated record of submission.
What retailers cannot do
Selling nicotine inhaling products to under-18s has been prohibited since 22 December 2023. The Department of Health's age restriction announcement explains the offence. Staff procedures need to reflect that rule.
Advertising restrictions apply around schools, on public transport and at transport stops and stations. Cinema advertising is restricted, with an exception for films classified for adults, and sales at events aimed at children are prohibited. These measures commenced on 23 September 2024, as explained in the Department's advertising update. A retail licence does not override them.
Other rules shops must follow
E-liquid tax: the HSE licence is separate from Revenue registration. Revenue says registration is required before making the first taxable supply of e-liquid in Ireland. A retailer sourcing stock from Irish suppliers does not need to register simply because it resells that stock. A retailer importing or producing liquid may have different obligations. Is a retail licence the same as e-liquid tax registration?
No. HSE retail licensing and Revenue E-liquid Products Tax registration are separate. The tax registration requirement generally falls on the supplier making the first taxable supply in Ireland.
When should a retailer renew a vape licence?
Licences run for 12 months. Section 15 provides continued validity pending a renewal decision where the renewal application was made at least 30 days before expiry. Keep the application receipt and follow the HSE renewal process.
